Respected Sir/s,

I am resident of Porvorim, Bardez, Goa and a Citizen of this country. I am belonging to Bhandari Community which has been declared as one of the category of Other Backward Classes in the state of Goa. I am also active member of Organization Gomantak Bhandari Samaj which is looking after the rights and interest of members of Bhandari Community and I have always taken interest for the upliftment of the Bhandari Community people.

It is learnt from the news item published in the local daily that the Goa Medical College, Bambolim and from the information obtained by me that GMC has finalized selection of the M.B.B.S students desirous of doing Post Graduate studies (Higher Studies) ignoring reservation of whatsoever nature for the Other Backward Classes students when such reservation ought to have been done clear injustice by not reserving any seats to the OBC category when the Government has issued Notifications granting reservation in educational institutions and in the present case the GMC authorities for the last few years have decided selection of General Category students to offer seats reserved for O.B.C. / S.C. / S. T. in total violation of the notified rules approved constitutionally by the Union Govt. and adopted by the Goa Govt.

From Notifications mentioned above it is seen that said benefit of reservation in admissible from academic year 2014-2015 and therefore, now it will also be necessary to see whether said benefit / facility was at all actually extended in the past from 2014-2015 to 219-2020 to said category students and if not, why and who decided to ignore or neglect said Rules and procedure . Since said act to ignore or disregard constitutional Rules is highly objectionable, arbitrary and doing injustice to the students who seek admission for such higher education from the reserve quota.

From the information which has been obtained by me it can be seen that consequent upon a complaint form one Shri. Namdev Fatarpekar filed before the State Commission for S.C. / S.T. at Panaji, the matter was heard in the presence of the representatives of the Deans of G.M.C. & G.D.C., Bambolim as well as the Under Secretary (Health) and having gone through the prevailing Rules prescribed for admissions to said institutions, order was passed by the said State Commission for S.C./S.T. to make applicable the said procedure while deciding the admission to the P.G. studies / courses for the current year 2020-2021. However, inspite of the said directions / order, admissions were unilaterally and hurriedly decided by the Dean, GMC, Bambolim on 30.04.2020 by completing the entire process in one single day, which indicates involvement of some vested interest in neglecting the order dated 22.04.2020 of the State Commission for S.C. / S.T., Panaji.

It is also given to understand that as against 61 seats under control of Goa State selection of 55 candidates have been decided against Goa category seats. And there is likeliness to increase the vacant seats coming under Central Govt. quota due to “Corona effect” this year. Also 2nd and 3rd phase of selection process is yet to be carried out by the G.M.C. Authorities.

I am aware that the admissions to the Post Graduate Studies / Degree Level Studies is being done as per the regulations framed by the Medical Council of India which itself permits the admission for the Post Graduate Medical Courses as per the Rules / Notifications, issued by the State Government and therefore there is absolutely no reason for the authorities to deny such reservations to the OBC community Candidates (Students).

From letter dates 04.05.2020 issued by the Under Secretary (Health) of Goa Government to the Dean, GMC, Bamholim, such reservations of seats for OBC / SC / ST Community Candidates (Students) is applicable, however, strangely in a said letter it has been stated that the Government will implement said reservation facility at the Post Graduate Level admissions from the next academic year i.e. 2021-2022, which is not only unreasonable but beyond imagination.

Under the above circumstances, it is requested that the vacant seats under state quota for the year 2020-2021 as well as vacancies likely to occur against the Central Govt. quota be filled up by the eligible candidates belonging to the O.B.C. / S.C. / S.T. category students in the light of Notifications quoted above as well as Order dt. 22.04.2020 issued by the State Commission for S.C. / S.T., Panaji.

Hope that the Government will look in to the matter and kindly do needful to reserve seats for post graduate medical admission at GMC even for the present year as well failing which I as member of the OBC from Bhandari Community will be constrained to approach the Hon’ble High Court seeking directions to the concerned authorities.
